Terms of Service

These Terms of Service ("Terms") cover your purchase and use of the Standing Pillars & Qigong video course ("the Course") from Medelian Martial Arts Academy ("we", "us", "our"), sold through medelianacademy.com ("the Site"). By buying or accessing the Course, you agree to these Terms. If you don't agree, please don't purchase or use the Course.
1. What the Course is
The Course is a paid, pre-recorded video course on qigong and standing-pole (zhan zhuang) practice. It's educational content about a physical practice — not medical advice, medical treatment, or a replacement for professional medical or physiotherapy guidance. Please read the Safety Disclaimer in Section 11 before you begin.
2. Access and your account
Once your payment goes through, you get access to the Course through your member account on the Site (which runs on Ghost). Please keep your login details private — your access is for you alone (see Section 3). If you have trouble getting in, email wdpimedelian@gmail.com.
3. Your licence — personal use only
When you buy the Course, we give you a personal, non-transferable, non-exclusive licence to watch the video content for your own learning. You may not:
- share your account or login with anyone else;
- download, copy, record, re-upload, resell, or redistribute the videos or any part of them;
- use the Course content to build a competing product or service.
If we have good reason to believe these rules have been broken, we may suspend or remove access without a refund.
4. Price and payment
The Course price is shown on the Site at the time you buy (currently $35, plus any taxes that apply where you live — see Section 8). Payments are handled securely by Stripe. We never see or store your full card details.
5. Refunds
The Course is digital content, and you get access to it immediately after you pay. At checkout you ask us to unlock that access straight away, and you agree that by doing so you give up the 14-day right of withdrawal that EU consumer law would otherwise give you for digital content. Once your purchase is complete and your access is unlocked, the sale is final and we do not offer refunds.
This does not affect legal rights that cannot be waived — for example, if the Course is faulty or significantly not as described, or where the law where you live gives you a right that still applies. If something is genuinely wrong, email wdpimedelian@gmail.com and we'll make it right. Full details are on our Refund Policy page.
6. Intellectual property
All the videos, text, images, and other materials in the Course belong to Medelian Martial Arts Academy or are used under licence. These Terms don't transfer any ownership to you — you receive a licence to watch, as described in Section 3.
7. Limitation of liability
As far as the law allows, we are not liable for any indirect, incidental, or consequential losses arising from your purchase or use of the Course. Our total liability for any claim connected to the Course will not be more than the amount you paid for it.
Nothing in these Terms removes or limits liability that can't be removed or limited by law — for example, liability for death or personal injury caused by our negligence, where local law doesn't allow that to be excluded. Please also read the Safety Disclaimer in Section 11.
8. Taxes
The price shown may not include taxes such as VAT. Where the law requires it, tax is calculated and added at checkout based on your location.
9. Changes to these Terms
We may update these Terms from time to time. If we make a significant change, we'll post the new version here with an updated "Last updated" date. If you keep using the Course after a change takes effect, that means you accept the updated Terms.
10. Governing law
These Terms, and your purchase, are governed by European Union consumer-protection law — including Directive 2011/83/EU on consumer rights and the General Data Protection Regulation (GDPR) — as applied through the national law of the country in which we are established. If you are a consumer resident in the EU, the mandatory consumer-protection rules of your own country continue to apply to you regardless of this clause.
11. Safety Disclaimer
Qigong and standing-pole (zhan zhuang) practice, as taught in the Course, are gentle physical practices. They are not medical treatment, and nothing in the Course is medical advice.
If you have an injury or a medical condition, are pregnant, or aren't sure whether a physical practice is safe for you, please talk to a doctor before you start.
Done as instructed, these practices are not inherently dangerous. Follow the instructions, stay within your own comfort and ability, and don't push through pain. As with any physical activity, practising incorrectly or beyond your limits can cause strain or injury — and that responsibility is yours when you practise on your own. To the extent the law allows, we are not liable for injuries caused by practising incorrectly or outside your own limits.
